New Independent Nurse Provider Eligibility Requirements - Non-enforcement Period

MassHealth is implementing a period of non-enforcement for recent regulation changes to provider eligibility requirements for currently enrolled independent nurses, which were published on October 9, 2026. For independent nurses who enrolled with MassHealth prior to October 9, 2026, there will be a period of non-enforcement until January 1, 2027, for the following requirements:

130 CMR 414.404: To participate in MassHealth as a MassHealth independent nurse provider, a nurse must

(G) maintain their own general and professional liability insurance to protect against claims of negligence, damage, or injury to a member or their property; and

(H) have an active certification, valid course completion card, or equivalent documentation reflecting completion of a basic life support (BLS) course with an in-person component from a reputable organization, including but not limited to, the American Red Cross or American Heart Association.

For providers enrolling with MassHealth as independent nurses on or after October 9, 2026, the provider eligibility requirements described in this message text and all other requirements under 130 CMR 414.000 will be applied at the time of enrollment.
